Disputes and Arbitration

You must allow Mashifu.us a reasonable opportunity to resolve your dispute. If you and Mashifu.us do not reach a resolution within sixty (60) days after receipt of your written notice, you may pursue your claim in arbitration or, where specifically permitted below, in court.
You and Mashifu.us agree to arbitrate all disputes between the parties. Arbitration uses a neutral arbitrator instead of a judge or jury and is subject to limited court review. The American Arbitration Association’s (“AAA”) Commercial Arbitration Rules and Supplementary Procedures for Consumer-Related Disputes will govern the arbitration. If your claim is for $10,000 or less, you may choose whether the arbitration is conducted by document submission, telephonic hearing, or in-person hearing. The arbitrator shall issue a written opinion explaining the essential findings and conclusions on which the decision is based.
Mashifu.us will pay all filing, administration, and arbitrator fees for claims of $75,000 or less. If you seek more than $75,000 in damages, the AAA rules will govern payment of fees.
YOU AND MASHIFU.US AGREE THAT ANY DISPUTE RESOLUTION PROCEEDINGS WILL BE CONDUCTED ONLY ON AN INDIVIDUAL BASIS AND NOT IN A CLASS OR REPRESENTATIVE ACTION.
YOU MAY CHOOSE TO PURSUE YOUR CLAIM IN COURT AND NOT BY ARBITRATION if your claim qualifies for small claims court in a location where jurisdiction and venue over you and Mashifu.us is proper, or if you opt out of arbitration within thirty (30) days of first accessing this Site by written notice to:

Governing Law
